Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Monnvia ("Monnvia", "we", "us") governing your use of the Monnvia website at monnvia.shop and the AI video generation services we provide (the "Service"). By using the Service you agree to these Terms.

1. The Service

Monnvia is an online AI Mermaid Video Generator. You provide a text prompt and, optionally, a photo, and the Service uses artificial intelligence to generate a short digital video (typically 6 to 15 seconds). The Service is provided entirely online; no physical goods are shipped.

2. Eligibility and accounts

  • You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase.
  • You are responsible for keeping your login details secure and for all activity under your account.
  • You must give accurate information and keep it up to date.
  • We may refuse service, or suspend accounts that break these Terms or our Acceptable Use Policy.

3. Credits, plans and payment

  • Generating videos uses credits. The number of credits per video depends on resolution and length and is shown before you generate and on the Pricing page. Visitors may also create a limited number of free videos each day without an account.
  • We offer monthly and yearly subscription plans and one-time credit packs. All prices are listed in US dollars (USD) and exclude applicable taxes, which are calculated at checkout.
  • Payments are processed by Stripe, Inc. and, where offered at checkout, PayPal, Inc. We do not store your full card or PayPal account details. Card charges appear on your statement as MONNVIA.SHOP.
  • Credits have no cash value, cannot be transferred or resold, and are not redeemable for money except as described in our Refund Policy.
  • Subscription credits are added every month (yearly plans receive the monthly allowance each month), reset at the next monthly allocation and do not roll over. Credit pack credits do not expire.
  • If a generation fails for a technical reason, the credits used are returned automatically.

4. Subscriptions and automatic renewal

Subscriptions renew automatically. When you subscribe, you authorize us to charge your payment method the plan price shown at checkout at the start of each billing period (monthly or yearly) until you cancel. We send a receipt for every charge and an email reminder at least 7 days before each yearly renewal.

You can cancel at any time using the “Manage subscription” link in your Stripe receipt email, or by emailing billing@monnvia.shop. Cancellation takes effect at the end of the current billing period. See our Cancellation Policy.

We may change plan prices. Any price change for an existing subscription takes effect only at your next renewal, and we will notify you by email at least 14 days in advance so you can cancel before it applies.

5. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

6. Your content

“Your Content” means the prompts and photos you submit. You keep ownership of Your Content. You grant us a limited, worldwide, non-exclusive license to host, process and transmit Your Content solely to operate the Service and generate your videos, including through our AI processing providers.

You promise that:

  • you own Your Content or have all rights needed to use it;
  • you have the consent of every identifiable person shown in any photo you upload;
  • you will not upload photos of minors or of public figures; and
  • Your Content does not infringe anyone's copyright, trademark, privacy or publicity rights.

7. Generated videos

Subject to these Terms and payment of any applicable fees, you may use the videos you generate (“Outputs”). Outputs created on the Free and Starter plans or with credit packs are licensed for personal, non-commercial use. Outputs created on the Pro and Studio plans may also be used commercially. You are responsible for how you use Outputs and for complying with the rules of any platform where you post them, including rules on labeling AI-generated content.

AI output is generated automatically and may be inaccurate, unexpected or similar to output created for other users. We do not guarantee that any Output will be unique or fit a particular purpose.

8. Acceptable use

You must follow our Acceptable Use Policy. In particular, the Service may not be used to create sexual or adult content, content involving minors in any inappropriate context, deepfakes of real people, content that infringes intellectual property (including copyrighted characters), or hateful, violent or illegal content. We screen prompts and may review, block or remove content and suspend accounts that violate the policy, without refund for violations.

9. Intellectual property

The Service, including our software, design, logos, sample media and the Monnvia name, belongs to Monnvia and its licensors and is protected by law. We respond to notices of alleged infringement as described in our Copyright & DMCA Policy. Monnvia is not affiliated with The Walt Disney Company or any film or franchise.

10. Third-party services

The Service relies on third parties, including cloud hosting, AI model providers and Stripe for payments. Their services are subject to their own terms. We are not responsible for third-party services we do not control.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation.

12. Limitation of liability

To the fullest extent permitted by law, Monnvia will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising from Your Content, your use of Outputs or your breach of these Terms.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms. Sections that by their nature should survive termination will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve the issue informally. If you are a consumer, you also keep any mandatory rights and remedies available in your country of residence.

16. Changes to these Terms

We may update these Terms. If a change is material, we will notify you by email or on the website at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
